Yes I want to know more Oh wise one..what is model 129...never heard of it......I can only tell you as it is.......as things really are here and as 99% of people coming here will find it........I have spent the last 5 years of my life standing in lines at Camara and finances......trying to find out more.....three Lawyers and two builders.....but I'm really interested to hear just how your Model 129 will clarify the question of Lamp Shades required or not prior to Habitation license..please do tell me........but what I can tell to anybody wanting to know is just plane facts as I have found them...and how they will find things ..trying to build here.......so before you acuse me of not doing my home work....try to understand that I'm posting here based on my experience and trying to help anybody that might want advise.again.......based on my experience.....but anyway I await your advise ref 129 and lampshades....

Would you please Mica elaborate a bit more as what is the rationale behind that D.L 38382. Why should old houses be exempt of Licença de Habitação? Even if it is a let down ruin?

Your question about lamp shades and modelo 129 puzzles me a bit.
If I may ask did anybody tell you that you may only put lamp shades after Licença de Habitação has been granted?

If the builders cross the dealine of the Licença de Construção the builder/owner as to require an extention for a fee. In the house where I live it was 50 Euros for more six months, but values depend on the council.
My wife and I still haven´t setled for a name to our villa. At first we put our son´s name, but droped it as the wife did not like the idea . For the moment the name is Esteva (the shrub that gives Algarve its sweet scent), but we will change that as well…guess what: the wife doesn´t like it. What about your villa? How are you going to name it?

Villa names...ah good point..I also dont know what to call my new Villa.....should it be a local Portuguese name ..or English ..what does everybody think.....

We bought our apartment in Lisboa and lived there for about six months before the entire block got its habitation whatsit. We were told that when the building gets inspected they will want to see inside a couple of the apartments; we will get advanced warning and we must remove the bedclothes……. A game they play

D.L (decree - lei ie law decree) 38382 was introduced on 7th August 1951. I don't know why it came about or the rationale behind it but having helped many people with various documents here, I do know that houses built before August 7th 1951 are exempt from having to have a habitation licence. The seller should ALWAYS provide the purchaser with either a habitation licence or the exemption certificate, otherwise it is not a good idea to buy the property. I am helping someone at the moment, who didn't get this document from her lawyer and it is causing her a few headaches, especially as she went ahead and started some renovation works, which will now require her to submit a project to the Câmara and request a habitation licence. The architect says that he can guarantee it but who knows here!!!! To get the exemption certificate for a property built before 7th August 1951, one needs to supply the following to the Câmara:
A set of topographical plans
Photographs
Property documents
Statement of 2 local witnesses
I will get round to registering soon, as I have broadband from today and am quite happy to offer advice on this and many other topics regarding purchasing property here either on this site or via a PM.
By the way "Ace" or "The wise one" hijacked the computer after me, after drinking too much beer and was a little obnoxious! Sorry about that. He actually does know quite a lot. I will check up on modelo 129 that he is quoting and report back.

Mica......Thats very interesting because I also had a few too many at that time and I thought it I that was being a bit obnoxious......interesting how a few beers change ones mood .......then you read what you wrote the nxt day and feel a bit guilty.........anyway ...my experience on the 1951 thingy was as follows.......I was going all through the Camara approval business and almost at the Building license stage..then at the last minute I had to get Bombaros and Agua certificates......(Another Month),,,..and then right at the last minute they wanted additional proof that the ruin was older than 1951...........how do I get that I asked...Oh you have to apply to the Camara.....but I'm at the Camara.......yes thats corredt , fill in this form.,
Form filled in and then told to go away and come back in 2 or 3 weeks.......They sent an Inspector to my Ruin to make sure it was still there and he decided if it was pre 1951.........this was in addition to other paperwork I had that stated it was pre 1951..........it took another month........bu the way it took me over 3 years to get a building license......and now..another 18 Months ...I'm still building.......Patience.!!!

I would very much apprerciate it if someone please could confirm that when a new villa (house etc) works are completed by the builder that he has to register it at the Tax Office (Finances) within 60days and I assuming submits a Modelo No 129 form (now I believe its called a Modelo No 1 form) i.e. for completion of his works.
