Planning permission - help with the process
Please can you advise me. I am trying to buy a property in Carvoeiro but have been advised by the agent that there is a problem with some planning permission which needs sorting out. Basically the property is about 20 years old and is on a well established development. At some point in the last 20 years, but not recently, the owner added an extra bedroom upstairs. The necessary planning permission was obtained but once the work was completed the owner either did not get or now can't find the 'licence'. I presume from this that all permissions have to be inspected once the work is complete and passed? The owner is being up front about this as he has already lost one potential buyer because of the problem. He is prepared to reapply for the necessary 'licence' but believes it may take 4-6 months to obtain. He has asked us to complete the purchase by giving him 90% of the final agreed price and will not ask for the final 10% until the licence has been obtained. Please can you let me know - does this process sound correct - what is the correct process and how should I proceed. I really like the property very much and have been looking for ages to find the right one - should I beware of a problem like this? The agent advises me that its a formality to get this 'licence'. Please help! I have a solicitor in CVO but have not had chance to discuss this with him yet.

Checks can be made with regard if and when planning consents were granted.
Until you have a clear picture of the history of the property that you wish to purchase you are strongly advised to not part with any monies.

If you want some help with it, feel free to e-mail me via clicking on the e-mail link below. It is relatively easy to find out if the room is legal or not. I can point you in the right direction. I wouldn't say things are always a "formality" in the Algarve. If it isn't legal and a retrospective project application is put in, it may get permission or it may not...I've seen both cases. It can also take longer than 6 months. If the agent is in Carvoeiro, I would personally use legal advice from another area and certainly not anyone recommended by the agent.
