Fiscal representation - IMI Tax

Hi all owners,

We have owned a property in Carvoeiro for 2 years and our solicitor has represented us paying our IMI tax with no charge as part of the service of buying the property through her. I am now told that my husband and I have to pay 250 euro EACH per year for her to represent us and this is a legal requirement as we cannot personally represent ourselves as non residents.

Can anyone please suggest a cheaper representative or advise as to what the situation is.

I know my lawyer is not taking on new clients - it has become a bit of a problem as the fiscal rep is liable for ALL your debts if "you do a runner" and they arent willing to take the risk now, clearly the last financal problems have hit a few!.

Several lawyers actually got burned by the tax man because they were holding rep for a number of "dorment" fiscal numbers.
The pitch was, that if you rep for someone, you should be charging them for it. However, as these numbers were created for the sole purpose of buying property, the lawyers never extended the repping service beyond the conclusion of the sale despite still being the registed rep on the fiscal number.

The background:
Over the last few years, the finances have been clamping down on non-resident fiscal numbers. New registrants have to present a fiscal rep before they can even get a number and old registrants have to update their finance department details to include a current address and a fiscal rep. With the burden of responsibility now residing squarely on the shoulders of the rep, this is no longer a service which comes cheap.

Consequently the tax man also assumes, that as repping is a service, lawyers were charging their clients but not declaring and thus had to pay a fine per represented number.

Needless to say, that after having to pay some whopping fines, the lawyer were quick to either offload the repping to financial advisory companies or start charging themselves for this service.

Thank you SO much Grabrinus for your kind and detailed explanation. I am still so confused over fiscal representation because we own a villa but do not rent it out, so do not do tax returns, although we have a bank account in carvoeiro which we had to produce a fiscal number for, and when we purchased the villa our lawyer said we had to get fiscal numbers. This is sooooo confusing.

I am told that if you do not rent out your villa you do not have to have a fiscal representative for paying your IMI tax and you can personally go to pay yourselves. I understand from my lawyer paying it on our behalf as a courtesy for representing us during the purchase that these payments are made twice yearly. In April and October. However I am now told that the payment is only once per year in April.

Forgive my utter ignorance but can you please shed some light on the above as you seem so brilliantly clued up.
