But I can't see this working if the buyer and seller reside in different countries, neither of which could be the country where the property is.

I would not be happy if I was selling my property in Portugal to somebody and they suddenly said they wanted it done according to the laws of Latvia, as an example.

interesting concept, but it may be better to consider a blanket EU rule rather than individual countries - potential corruption springs to mind.
