Change of title

Post by biffa »

This is a BIG question! Any change of title will involve substantial cost as transfer tax (IMT) should be paid. It may alos involve capital gains!
Probably a good idea to get a firm quote and for that I would need to see existing deed (escritura) and know potential transfer cost. PM me if you like. :D

I should have thought that the bigger potential risk is capital gains tax. As a realistic sale price has to be declared there could be a large gap between this and the value recorded when the company purchased the property. If by any chance the property has ever been revalued for IMT the valor patrimonial might be higher than the original purchase value and as I understand the position this could be used a the base for CGT. Potentially, however, a can of worms and sound advice is needed.
