Read it earlier. For goodness sake - this needs to get sorted! The reporter is correct when he says that people will stop purchasing property in Portugal if they are not allowed to rent it out. I would like to be able to rent my apartment out, but there is no way that I am going to run the risk of fines. I am lucky in that I don't have a mortgage, but some people will have purchased properties with a mortgage on the assumption that rental will go towards costs. What a nightmare.

Well yes, we have a mortgage and although we could survive without rental income, every little helps!

Our lawyer certainly didn't mention this law when we bought 18 months ago and she knew we intended to rent and even offered to arrange the insurance!

I notice there is frequent reference to what will happen if this hits the UK press - well maybe it's time it did or there was a threat that it will. Obviously that will probably adversely affect the rental market, as predicted but if we're already too afraid to rent for fear of fines.........Maybe a threat would be all that's needed to bring them to their senses. Anyone know any tame reporters???

Bit tricky that, because if it hits the UK press properly, the only people to suffer will be those of us who purchased properties at the current high prices. Prices will undoubtedly drop and that is good news for locals and bad news for anyone who has purchased in the last 1-2 years.

They DO need to sort something out though. At the moment it is a valid excuse for me not to let my lovely apartment out to people I don't know - but if the value drops, as well as not being allowed to rent it out, then I shan't be very happy!

speaking today to someone who runs a rental agency, seems that two of their clients have applied to silves camara for b and b licences which are being issued by silves ..the two clients are the guinea pigs to see what happens. lagoa camara have done nothing as yet.

the process costs 2000 euros of which 1500 is for the architect to draw up plans showing what I have no idea.

unfornunately that is not the end of the matter as once the b & b licence is given then qrtly returns have to be made by an accountant and so on and so on

the agency says many people have put their places up for sale as a result of all of this mess.

sounds like a repeat performance of the offshore saga, perhaps those members of this forum who live in the uk and ireland should contact their national daily papers, perhaps some bad publicity about this and the effect its having would stop this crisis from turning into a disaster

I've been very tempted! Problem is doing that may turn it into a crisis for all of us who want to let - if people are put off coming to Algarve it could take a long time for things to pick up. Also I'm not sure we want to be another catalyst for a drop in property prices......
Surely something's going to have to give!

we want to rent out our villa this year as we also have a mortgage on it and had been hoping that we would have enough rental from family / friends / or work colleges, people they knew etc, as we are unsure of advertising on the various websites with regards to a tourist licence, as no one seems to know what is happening and we do not want to get fined. It is a new villa so has many of the safety requirements, including emergency lighting inside and out, fire extinguishers etc, as my husband has to deal with health and safety requirements at work. But of course we do not have any disable access as where we are situated it would be unsuitable for anyone with a disablity.
Don't now what to do any idea's anyone.

We have decided NOT to rent out our villa, when completed later this year as all the hassle seems more trouble than its worth.

I would suggest that the value of apartments is driven more by rental income potential but as the majority of these are on existing " touristic " developments there should not be too many major issues.
When this is finally sorted out the end result will probably be a fall in the nett income villa owners receive and a rise in the
" set up costs " in getting your villa to the qualifying standard.

Question, With leasebacks to developers becoming increasingly popular along with fractional ownership, how are these going to be treated.
Who picks up the cost ??

in kenya may years ago, to get around the fact that no one was allowed to buy a charter airline ticket by just walking off the street, you had to belong to a club to get a ticket or pay the massive ticket price demanded by kenya or british airways

so all the east african asians did (who were the main people behind charter tickets) was to form loads of clubs...eg the east african elephant appreciation club..the plane was chartered for these "club members" who paid for their membership at the time of their ticket purchase (about 1 euro)

so for anyone who wants to rent their villa to tourists , dont bother - instead let the villa be used for a "study group" belonging for example to the algarve carob tree research society

not that easy if you consider that there are only three definitions for inhabitants:

1. Owner or family
2. Long-term rental customer
3. Tourist

No matter how you twist it, if the inhabitant is not the owner or hold a valid long-term rental contract, he is a tourist.

So surely you create a 'long term rental contract' with the newly formed 'Carvoeiro Golf Society' which can be used by their members. Membership fees may well equate to roughly a weeks villa rental?

....you could try, but any half-wit legal aid could put two and two together and the ASAE would feed you that contract for breakfast before the season is out.

Plus, you have to declare a monthly income wether you rent out the property or not. Put that rent too low to minimize potencial loss and the finanças may decide to take a closer look at you.

....but keep wriggling, who knows, maybe you can find a loophole

why not then if it is number one ..owner or family - try this-

all visitors to (for example) Grahams villa belong to the Graham Family Tree
Club ---surely someone and everyone is related to each other (if you go far enough back! )

what about it cousin Graham? :lol:

do hope someone can contact the papers - let me tell you a true story

a woman who lived in the west of the algarve had along with her neighbours months and months of road works outside their houses, despite petitions and complaints to the camara and contractor to get the job finished all they got was the shrug of the shoulders

so the lady went back to uk on holiday and telling her daughter the saga who worked in the media, the daughter pretended to be a producer for a C4 show and rang the embassy in London to ask if they had any info or comment about the mess in the town as the daughters "production filming crew" would be going out soon to film for a segment on "hell holidays"
- she said she would ring back in a couple of weeks for a final comment

so two weeks pass and the daughter phones the embassy again for their comment and to let them know they would be leaving next week to film and they didnt need pemission to film anyway so it would be featured regardless.

so anyway the mother returns the following week and guess what?

yup the road works are almost complete!

so a bit of publicity can work wonders.
