Maid's sick pay?
Can anyone tell me whether it is law that we must pay the maid when she is on sick leave? We are paying for a substitute maid by the hour but our Management Company are also asking us for the permanent maid's monthly salary.

We like her very much and would be sad to loose her. The temporary maid is not quite so good

sick pay is not paid for the first three or five days and from then on only 60 or 70% of the salary is payable.
This is only if she is only contracted to you and you pay her social security every month.

It's a bit of a minefield generally I don't know just what the rules are, most of them have three or more villas to service so if that's the case with yours I suppose you'd pay he a quarter of her income.

Temporary sickness/incapacity (incapacidade temporária)
A cash benefit is available for qualifying workers who are temporarily too ill or incapacitated to continue working. The self-employed may also be eligible for this benefit if their social security scheme includes it.
In order to be eligible, the worker must have worked (and contributed to social security) for at least six months prior to the accident or sickness, and worked at least 12 days in the 4 months immediately preceding the incapacity. The self-employed and those voluntarily contributing to the social security system must have contributed until at least the end of the third month prior to the accident.
The hospital or doctor treating the patient will provide a Temporary Incapacity Certificate (Certificado de Incapacidade Temporária por Estado de Doença - CIT). This must be sent to the Social Security Institute within five days of the patient's receipt. The Social Security Institute and the employer have the right to request subsequent medical assessments.
Up to 75 percent of reference earnings (generally the salary paid in the six months prior to the incapacity divided by 180) will be paid, depending on the duration of the incapacity. Individuals with tuberculosis are entitled to a greater percentage.

We have had our maid for 12 years, and we pay her NI.
She has occasional days sick, and we just bite the bullet on it, based on the premise that she has been with us a long time and has almost become one of the family.
I think your management company should be able to advise you as to what the position is with longer term sickness.
I think that I would get her to apply for whatever Social security payments she is entitled to, and then maybe top it up.

Thanks everyone for that information. The Maid has now agreed with the Management Company that she does not expect any more wages until she returns to work. She has been paid 2 months already.
It all seems a rather complicated system with no set rules. We hope she will be getting some compensation from the person who caused her road accident.

...it's as easy as: Have the maid properly registered & pay social security & benefit from social system OR let the maid be "self-employed" & risk fiscal fraud & possible claims in case of accident (her|paying guests|...)It all seems a rather complicated system with no set rules

Maternity leave is the one you've got to be aware of, especially if you're involved.
