The Consumer Credit Act 1974, section 75, "equal liability" where the credit provider (credit card company) is libel for any breach of contract by the service provider. A court case many years ago held that section 75 applied to credit card transactions involving transactions with suppliers in other countries. The ECC, via Chartered Institute of Trading Standards, are the UK reps for inter EU consumer complaints.
we have just found out that under the law we can now go to our bank and they can make a charge back so we can now get all our money back but a up date with atlaschoice are now up and running again but anyone one that has pre booked like us they will not be honouring our vouchers we phoned them and they was very nice and was asked if we would still like to book with them we did decline

So atlaschoice are now trading again? They have the audacity to ask you if you want to book with them again when they have already ripped you off! They do not deserve to get a single booking if they have ripped customers off & then started trading again the cheeky *astards !

update would you believe we are still trying to get our money back off to the bank yet again and a load more e/mails in hand we had a letter for the car we rented last nov telling us that the car company had taken payment again but have got that one back but as for the two payments made for this year is still a fight will keep you updated when we get back from the bank

I'm still puzzled over how you paid and how you are trying to get your money back.

If you paid by Cedit Card then Section 75 as mentioned above applies and your credit card company should refund you (which is nothing to do with your bank unless they are the card issuer). All you should need to do is phone the credit card company to make a claim.

If you paid by debit card then Charge Back applies and the process to invoke this is equally straightforward.

If you paid by money transfer direct to the car rental firm then the liability is yours and your relationship is the same as any other creditor and your bank has no liability.

However, all the above may be irrelevant if you have travel insurance and that was valid before you made the rental booking. You would then be able to claim from your insurer but they would probably want full proof of everything.

If you had travel insurance and also paid by one or other form of plastic then the insurer will probably try to get you to claim off the card company.

You can get your money back by charge back if the company you paid agree that they owe you the company we paid for the car rental agree they owe us but in our case the bank is the one's holding it up as they are charged a small amount cpl of pounds but it's been going on for so long and its been so hard that we have given up
